1. Introduction
This Acceptable Use Policy ("AUP") defines the terms and conditions for using the services provided by MediaCP – Media Server Hosting, Petr Maléř (Sole Proprietor / OSVČ), ID (IČO): 11983060, Václava Košaře 61/30, 700 30 Ostrava, Czech Republic, e-mail: [email protected], web: www.mediacp.eu.
This policy is an integral part of the General Terms and Conditions. By using the services, the customer agrees to comply with these rules.
2. General Principles
MediaCP services may only be used in compliance with the legal framework of the Czech Republic, the legal regulations of the European Union, international obligations and this policy. The customer is responsible for all activities carried out through their account.
3. Prohibited Activities
It is strictly prohibited to use the services for any illegal or harmful activity.
3.1 Copyright Infringement
It is not permitted to broadcast music without the required licenses, retransmit television content without authorization, stream pirated content, distribute content that infringes copyright, or distribute illegal copies of movies, series, music or software. The customer is responsible for securing all necessary licenses and permissions.
3.2 Illegal IPTV and TV Retransmission
It is prohibited to operate illegal IPTV services, retransmit TV channels without the consent of the rights holders, distribute paid content without authorization, or provide access to illegal streams. MediaCP may suspend such services immediately without prior notice.
3.3 Spam
It is prohibited to send unsolicited commercial communications (spam), bulk-send e-mails without the recipient's consent, operate spamming systems, or use the services to promote spam.
3.4 Malware
It is prohibited to distribute malicious software, or host viruses, ransomware, spyware, Trojan horses or malicious scripts.
3.5 Phishing and Scams
It is prohibited to create fake login pages, harvest third-party login credentials, impersonate other individuals or entities, operate fraudulent services, or organize online scams.
3.6 Unauthorized Access
It is not permitted to attempt to gain unauthorized access to systems, launch attacks against servers, bypass security measures, exploit system vulnerabilities, or test security defenses without the system owner's explicit consent.
3.7 DDoS and Network Attacks
It is prohibited to execute DDoS attacks, organize attacks against network infrastructure, host tools designed for launching attacks, operate botnets, or abuse network resources.
3.8 Cryptocurrency Abuse
The following is not allowed without prior written consent: running cryptocurrency mining operations, utilizing server resources for mining, or operating services that cause an unreasonable load on the infrastructure.
3.9 Illegal Content
It is prohibited to store or distribute content that violates applicable legal regulations, incites or promotes violence, promotes terrorism, infringes upon the rights of third parties, contains child pornography, or violates personal data protection laws. Such content will be removed immediately and reported to the competent authorities.
4. Streaming Services
The customer is fully responsible for broadcast content, stream metadata, advertising announcements, licensing rights and compliance with copyright laws. MediaCP does not perform any pre-screening of broadcasted content.
5. VPS Services
For VPS services, the customer is primarily responsible for securing the operating system, installing system updates, managing user accounts, configuring the firewall and the software running on the server. MediaCP bears no responsibility for damages caused by improper VPS management on the part of the customer.
6. Reseller Services
The reseller is responsible for the actions of their own customers. Violation of this policy by an end-user may lead to service limitation, account suspension, or termination of the reseller service.
7. Abuse Reporting
Violations of this policy can be reported to [email protected]. The report should include identification of the service involved, a description of the issue, supporting evidence and contact information of the reporter. MediaCP may request additional information if necessary.
8. Incident Investigation
MediaCP reserves the right to investigate reported violations, request explanations from the customer, temporarily suspend the service, remove objectionable content, and cooperate with law enforcement and authorized authorities.
9. Sanctions
In the event of a policy violation, MediaCP may take the following actions:
- Level 1 — issue a warning notice and request immediate remediation.
- Level 2 — suspend the service and restrict account features.
- Level 3 — terminate the service immediately, delete all stored data and refuse future provision of services.
The choice of enforcement measures depends on the severity of the violation.
10. Indemnification and Damages
The customer is liable for any damages caused by violating this policy. If MediaCP is exposed to third-party claims due to the actions of the customer, the customer is obliged to compensate for the damage incurred to the extent permitted by legal regulations.
11. Policy Changes
MediaCP reserves the right to modify this policy at any time. The current version will always be published on the website.
12. Final Provisions
This policy forms part of the contractual relationship between the customer and MediaCP. By using the services, the customer acknowledges that they have read, understood and agreed to its terms.

1. Úvod
Tyto zásady přijatelného užívání („AUP“) vymezují podmínky používání služeb poskytovaných: MediaCP – Media Server Hosting, Petr Maléř (OSVČ), IČO: 11983060, Václava Košaře 61/30, 700 30 Ostrava, Česká republika, e-mail: [email protected], web: www.mediacp.eu.
Tyto zásady jsou nedílnou součástí obchodních podmínek. Používáním služeb zákazník souhlasí s dodržováním těchto pravidel.
2. Obecné zásady
Služby MediaCP lze používat pouze v souladu s právním řádem České republiky, právními předpisy Evropské unie, mezinárodními závazky a těmito zásadami. Zákazník odpovídá za veškerou činnost prováděnou prostřednictvím svého účtu.
3. Zakázané činnosti
Je přísně zakázáno používat služby k jakékoli nezákonné nebo škodlivé činnosti.
3.1 Porušování autorských práv
Není dovoleno vysílat hudbu bez potřebných licencí, přenášet televizní obsah bez oprávnění, streamovat pirátský obsah, šířit obsah porušující autorská práva ani distribuovat nelegální kopie filmů, seriálů, hudby či softwaru. Zákazník odpovídá za zajištění všech potřebných licencí a oprávnění.
3.2 Nelegální IPTV a přenos TV
Je zakázáno provozovat nelegální IPTV služby, přenášet TV kanály bez souhlasu držitelů práv, distribuovat placený obsah bez oprávnění nebo poskytovat přístup k nelegálním streamům. MediaCP může takové služby okamžitě pozastavit bez předchozího upozornění.
3.3 Spam
Je zakázáno rozesílat nevyžádaná obchodní sdělení (spam), hromadně rozesílat e-maily bez souhlasu příjemce, provozovat spamovací systémy nebo využívat služby k propagaci spamu.
3.4 Malware
Je zakázáno šířit škodlivý software nebo hostovat viry, ransomware, spyware, trojské koně či škodlivé skripty.
3.5 Phishing a podvody
Je zakázáno vytvářet falešné přihlašovací stránky, sbírat přihlašovací údaje třetích stran, vydávat se za jiné osoby či subjekty, provozovat podvodné služby nebo organizovat online podvody.
3.6 Neoprávněný přístup
Není dovoleno pokoušet se o neoprávněný přístup do systémů, vést útoky proti serverům, obcházet bezpečnostní opatření, zneužívat zranitelnosti systémů ani testovat bezpečnostní ochranu bez výslovného souhlasu vlastníka systému.
3.7 DDoS a síťové útoky
Je zakázáno provádět DDoS útoky, organizovat útoky proti síťové infrastruktuře, hostovat nástroje určené k útokům, provozovat botnety nebo zneužívat síťové prostředky.
3.8 Zneužití kryptoměn
Bez předchozího písemného souhlasu není dovoleno provozovat těžbu kryptoměn, využívat serverové prostředky k těžbě ani provozovat služby způsobující nepřiměřenou zátěž infrastruktury.
3.9 Nelegální obsah
Je zakázáno ukládat nebo šířit obsah, který porušuje platné právní předpisy, podněcuje nebo propaguje násilí, propaguje terorismus, zasahuje do práv třetích stran, obsahuje dětskou pornografii nebo porušuje předpisy o ochraně osobních údajů. Takový obsah bude okamžitě odstraněn a nahlášen příslušným orgánům.
4. Streamovací služby
Zákazník nese plnou odpovědnost za vysílaný obsah, metadata streamu, reklamní sdělení, licenční práva a soulad s autorským právem. MediaCP neprovádí žádnou předběžnou kontrolu vysílaného obsahu.
5. VPS služby
U služeb VPS zákazník odpovídá zejména za zabezpečení operačního systému, instalaci aktualizací, správu uživatelských účtů, konfiguraci firewallu a software běžící na serveru. MediaCP nenese odpovědnost za škody způsobené nesprávnou správou VPS ze strany zákazníka.
6. Reseller služby
Reseller odpovídá za jednání svých vlastních zákazníků. Porušení těchto zásad koncovým uživatelem může vést k omezení služby, pozastavení účtu nebo ukončení reseller služby.
7. Hlášení zneužití
Porušení těchto zásad lze nahlásit na [email protected]. Hlášení by mělo obsahovat identifikaci dotčené služby, popis problému, podpůrné důkazy a kontaktní údaje oznamovatele. MediaCP si může v případě potřeby vyžádat doplňující informace.
8. Vyšetřování incidentů
MediaCP si vyhrazuje právo vyšetřovat nahlášená porušení, vyžádat si od zákazníka vysvětlení, dočasně pozastavit službu, odstranit závadný obsah a spolupracovat s orgány činnými v trestním řízení a oprávněnými úřady.
9. Sankce
V případě porušení těchto zásad může MediaCP přijmout následující opatření:
- Úroveň 1 — vydání varování a výzva k okamžité nápravě.
- Úroveň 2 — pozastavení služby a omezení funkcí účtu.
- Úroveň 3 — okamžité ukončení služby, smazání všech uložených dat a odmítnutí budoucího poskytování služeb.
Volba opatření závisí na závažnosti porušení.
10. Odškodnění a náhrada škody
Zákazník odpovídá za veškeré škody způsobené porušením těchto zásad. Bude-li MediaCP vystaveno nárokům třetích stran v důsledku jednání zákazníka, je zákazník povinen vzniklou škodu nahradit v rozsahu povoleném právními předpisy.
11. Změny zásad
MediaCP si vyhrazuje právo tyto zásady kdykoli změnit. Aktuální verze bude vždy zveřejněna na webu.
12. Závěrečná ustanovení
Tyto zásady tvoří součást smluvního vztahu mezi zákazníkem a MediaCP. Používáním služeb zákazník potvrzuje, že si je přečetl, porozuměl jim a souhlasí s nimi.

Diese Richtlinie ist integraler Bestandteil der Allgemeinen Geschäftsbedingungen. Mit der Nutzung der Dienste erklärt sich der Kunde mit der Einhaltung dieser Regeln einverstanden.
2. Allgemeine Grundsätze
Die Dienste von MediaCP dürfen nur in Übereinstimmung mit der Rechtsordnung der Tschechischen Republik, den Rechtsvorschriften der Europäischen Union, internationalen Verpflichtungen und dieser Richtlinie genutzt werden. Der Kunde ist für sämtliche über sein Konto durchgeführten Aktivitäten verantwortlich.
3. Verbotene Aktivitäten
Es ist strengstens untersagt, die Dienste für illegale oder schädliche Aktivitäten zu nutzen.
3.1 Urheberrechtsverletzung
Es ist nicht gestattet, Musik ohne die erforderlichen Lizenzen zu senden, Fernsehinhalte ohne Genehmigung weiterzuverbreiten, Raubkopien zu streamen, urheberrechtsverletzende Inhalte zu verbreiten oder illegale Kopien von Filmen, Serien, Musik oder Software zu verbreiten. Der Kunde ist für die Beschaffung aller erforderlichen Lizenzen und Genehmigungen verantwortlich.
3.2 Illegales IPTV und TV-Weiterverbreitung
Es ist untersagt, illegale IPTV-Dienste zu betreiben, TV-Kanäle ohne Zustimmung der Rechteinhaber weiterzuverbreiten, kostenpflichtige Inhalte ohne Genehmigung zu verbreiten oder Zugang zu illegalen Streams bereitzustellen. MediaCP kann solche Dienste sofort und ohne Vorankündigung sperren.
3.3 Spam
Es ist untersagt, unerwünschte kommerzielle Mitteilungen (Spam) zu versenden, Massen-E-Mails ohne Einwilligung des Empfängers zu versenden, Spamming-Systeme zu betreiben oder die Dienste zur Förderung von Spam zu nutzen.
3.4 Malware
Es ist untersagt, Schadsoftware zu verbreiten oder Viren, Ransomware, Spyware, Trojaner oder schädliche Skripte zu hosten.
3.5 Phishing und Betrug
Es ist untersagt, gefälschte Anmeldeseiten zu erstellen, Anmeldedaten Dritter abzugreifen, sich als andere Personen oder Stellen auszugeben, betrügerische Dienste zu betreiben oder Online-Betrug zu organisieren.
3.6 Unbefugter Zugriff
Es ist nicht gestattet, unbefugten Zugriff auf Systeme zu versuchen, Angriffe gegen Server zu starten, Sicherheitsmaßnahmen zu umgehen, Systemschwachstellen auszunutzen oder Sicherheitsvorkehrungen ohne ausdrückliche Zustimmung des Systemeigentümers zu testen.
3.7 DDoS- und Netzwerkangriffe
Es ist untersagt, DDoS-Angriffe durchzuführen, Angriffe gegen die Netzwerkinfrastruktur zu organisieren, Werkzeuge zum Starten von Angriffen zu hosten, Botnetze zu betreiben oder Netzwerkressourcen zu missbrauchen.
3.8 Missbrauch von Kryptowährungen
Ohne vorherige schriftliche Zustimmung ist Folgendes nicht gestattet: der Betrieb von Kryptowährungs-Mining, die Nutzung von Serverressourcen zum Mining oder der Betrieb von Diensten, die eine unangemessene Belastung der Infrastruktur verursachen.
3.9 Illegale Inhalte
Es ist untersagt, Inhalte zu speichern oder zu verbreiten, die geltende Rechtsvorschriften verletzen, zu Gewalt aufrufen oder Gewalt fördern, Terrorismus fördern, in die Rechte Dritter eingreifen, Kinderpornografie enthalten oder Datenschutzvorschriften verletzen. Solche Inhalte werden sofort entfernt und den zuständigen Behörden gemeldet.
4. Streaming-Dienste
Der Kunde ist vollständig verantwortlich für gesendete Inhalte, Stream-Metadaten, Werbeansagen, Lizenzrechte und die Einhaltung des Urheberrechts. MediaCP führt keine vorherige Prüfung der gesendeten Inhalte durch.
5. VPS-Dienste
Bei VPS-Diensten ist der Kunde in erster Linie verantwortlich für die Absicherung des Betriebssystems, die Installation von Updates, die Verwaltung von Benutzerkonten, die Konfiguration der Firewall und die auf dem Server laufende Software. MediaCP übernimmt keine Verantwortung für Schäden durch unsachgemäße VPS-Verwaltung seitens des Kunden.
6. Reseller-Dienste
Der Reseller ist für das Handeln seiner eigenen Kunden verantwortlich. Ein Verstoß gegen diese Richtlinie durch einen Endnutzer kann zur Einschränkung des Dienstes, zur Sperrung des Kontos oder zur Beendigung des Reseller-Dienstes führen.
7. Meldung von Missbrauch
Verstöße gegen diese Richtlinie können an [email protected] gemeldet werden. Die Meldung sollte die Identifikation des betroffenen Dienstes, eine Beschreibung des Problems, unterstützende Nachweise und die Kontaktdaten des Meldenden enthalten. MediaCP kann bei Bedarf zusätzliche Informationen anfordern.
8. Untersuchung von Vorfällen
MediaCP behält sich das Recht vor, gemeldete Verstöße zu untersuchen, vom Kunden Erklärungen anzufordern, den Dienst vorübergehend zu sperren, anstößige Inhalte zu entfernen und mit Strafverfolgungs- und befugten Behörden zusammenzuarbeiten.
9. Sanktionen
Im Falle eines Verstoßes gegen diese Richtlinie kann MediaCP folgende Maßnahmen ergreifen:
- Stufe 1 — Verwarnung und Aufforderung zur sofortigen Behebung.
- Stufe 2 — Sperrung des Dienstes und Einschränkung der Kontofunktionen.
- Stufe 3 — sofortige Beendigung des Dienstes, Löschung aller gespeicherten Daten und Verweigerung künftiger Diensterbringung.
Die Wahl der Durchsetzungsmaßnahmen hängt von der Schwere des Verstoßes ab.
10. Freistellung und Schadensersatz
Der Kunde haftet für alle durch einen Verstoß gegen diese Richtlinie verursachten Schäden. Wird MediaCP aufgrund des Handelns des Kunden Ansprüchen Dritter ausgesetzt, ist der Kunde verpflichtet, den entstandenen Schaden im gesetzlich zulässigen Umfang zu ersetzen.
11. Änderungen der Richtlinie
MediaCP behält sich das Recht vor, diese Richtlinie jederzeit zu ändern. Die aktuelle Fassung wird stets auf der Website veröffentlicht.
12. Schlussbestimmungen
Diese Richtlinie ist Teil des Vertragsverhältnisses zwischen dem Kunden und MediaCP. Mit der Nutzung der Dienste bestätigt der Kunde, dass er sie gelesen, verstanden und ihren Bedingungen zugestimmt hat.
