Terms & Conditions – Rights and Licenses for Audio, Video & IPTV Streaming

1. General Provisions

These Terms & Conditions govern the rights and obligations between MediaCP – Media Server Hosting (hereinafter referred to as the “Provider”) and the customer (hereinafter referred to as the “User”) when using audio, video, IPTV, VoD and related streaming and hosting services provided via the MediaCP platform.

By using the services, the User confirms that they have read, understood, and agree to these Terms.


2. Responsibility for Content

  1. The User is fully responsible for all content transmitted, stored, or otherwise made available through the Provider’s services.

  2. The Provider bears no responsibility for the legality, accuracy, quality, or origin of the transmitted content.

  3. The User agrees not to distribute content that:

    • infringes copyright, related rights, or intellectual property rights,

    • violates the laws of the Czech Republic, the European Union, the United States, or applicable international laws,

    • contains illegal, hateful, violent, or otherwise prohibited material.


3. Audio Streaming – Rights & Licenses

  1. The User is required to obtain and maintain all necessary licenses and permissions for broadcasting audio and music content.

  2. This includes, but is not limited to, licenses from collective rights organizations such as OSA, Intergram, GEMA, PRS, ASCAP, BMI, SESAC, or equivalent organizations.

  3. The Provider does not grant any music or audio licenses and does not act as a rights management organization.

  4. Upon request, the User must provide proof of valid licenses.


4. Video Streaming & VoD – Rights & Licenses

  1. The User must ensure that all video and audiovisual content streamed or stored via the Provider’s services is properly licensed.

  2. This includes rights to:

    • live video streaming,

    • television broadcasting,

    • sports events,

    • movies, series, and video-on-demand (VoD) content.

  3. Streaming or redistribution of copyrighted video content without explicit authorization is strictly prohibited.

  4. The Provider shall not be liable for unauthorized video distribution by the User.


5. IPTV Services – Rights & Legal Use

  1. IPTV services may only be used for content to which the User holds valid broadcasting or redistribution rights.

  2. Illegal IPTV services, including retransmission of paid television channels without authorization, are strictly forbidden.

  3. The Provider does not supply or resell TV channels, content licenses, or broadcasting rights.

  4. Any misuse of IPTV services will result in immediate service suspension or termination.


6. DMCA & Copyright Infringement Policy (USA-Friendly)

  1. MediaCP complies with the Digital Millennium Copyright Act (DMCA) and similar international copyright regulations.

  2. If the Provider receives a valid DMCA takedown notice or copyright infringement complaint, the affected service may be suspended or terminated without prior notice.

  3. Repeated copyright violations may result in permanent account termination.

  4. The User agrees to indemnify and hold harmless the Provider from any claims, damages, or legal costs arising from copyright infringement.


7. Monitoring & Enforcement

  1. The Provider reserves the right to suspend, restrict, or terminate services if there is reasonable suspicion of legal or contractual violations.

  2. The Provider is not obligated to actively monitor content but reserves the right to do so.

  3. Cooperation with legal authorities and rights holders is permitted when required by law.


8. Liability & Indemnification

  1. The User is fully liable for any damages, penalties, or costs incurred by the Provider due to violations of these Terms.

  2. The User agrees to indemnify the Provider against all third-party claims related to transmitted content.


9. Prohibited Use

The services must not be used for:

  • piracy or illegal streaming,

  • unauthorized IPTV redistribution,

  • bypassing DRM or licensing restrictions,

  • reselling content without permission.


10. Termination of Services

Violation of these Terms, particularly copyright and licensing obligations, constitutes a material breach and may result in immediate termination without refund.

URL and Port streams

If a customer terminates his service, his PORT and URL address will be available for a new client, because the panel allocates free ports automatically for new clients


11. Governing Law

  1. These Terms are governed by the laws of the Czech Republic, unless mandatory international regulations apply.

  2. The Provider reserves the right to amend these Terms at any time.

  3. The current version is always available at mediacp.eu.
