General Terms and Conditions of MediaCP.eu
1. Introductory Provisions
1.1 These Terms and Conditions govern the relationship between the service provider MediaCP.eu (hereinafter referred to as the “Provider”) and the customer (hereinafter referred to as the “Customer”).
1.2 The services provided by the Provider include in particular: rental of streaming servers (Shoutcast, Icecast), VPS, AutoDJ, IPTV, VoD and other services related to the broadcasting of multimedia content.
1.3 By confirming the order, the Customer agrees to these Terms and Conditions.
2. Legal Liability and Licensing
2.1 The Provider is not responsible for the content that the Customer broadcasts through the services provided. The Customer is fully responsible for ensuring that his broadcast does not violate copyright or any laws applicable in his country.
2.2 The Customer is obliged to secure all necessary licenses and authorizations for broadcasting according to the legal regulations applicable in the country from which he broadcasts or where the content is available.
2.3 In the event of a violation of the law or complaints from rights holders, the provider reserves the right to temporarily or permanently suspend the service without compensation.
3. Prices and payment terms
3.1 The prices of the services are listed in the current price list on the MediaCP.eu website.
3.2 The services are charged in advance. Invoicing is automatic according to the selected billing period.
3.3 All payments are binding and non-refundable. The provider does not refund money for early termination of the service, unused period or canceled orders.
4. Termination and cancellation of the service
4.1 The customer can cancel the service at any time via the client interface, but without the right to a refund.
4.2 The provider reserves the right to cancel the service in the event of a violation of these terms and conditions or the laws of the Czech Republic, the EU or the customer’s country.
5. Personal data protection
5.1 The provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR). For more information, please see the Privacy Policy.
6. Governing Law
6.1 These Terms and Conditions are governed by the law of the Czech Republic.
6.2 All disputes arising between the Provider and the Customer will be resolved amicably as a priority. If an amicable solution cannot be reached, the dispute will be resolved by the competent court in the Czech Republic.
7. CONDITIONS OF USE AND COPYRIGHT
MediaCP provides audio-phonic transmission services via the internet to its customers. By using our services, you agree to be bound by these terms and conditions.
7.1 Content and Copyright
MediaCP is not responsible for the Content transmitted, broadcasted, and/or published by the customer. The customer is solely responsible for obtaining all proper licenses, entitlements, and agreements allowing them to legally broadcast audio-phonic transmission via the internet and for covering all required royalties.
7.2 Service Limits
Customers are responsible for monitoring the limits assigned to their service. If these limits are exceeded, the service may be turned off automatically.
7.3 Compliance with Rules and Laws
MediaCP reserves the right to block and prevent the hosting of radio or TV broadcasts in case of violation of our server rules and the laws of the Czech Republic. We may also block such broadcasts if the server administrator finds them inadmissible in any direction. MediaCP – Media Server Hosting bears no responsibility for possible unavailability of services or instability of the connection to the MediCP – Server Hosting service is located in Europe, customers from other parts of the country may experience outages and unavailability of services, this applies to South and North America
7.4 Refund Policy
If the subscriber cancels radio hosting within three (3) calendar days of registration, they will receive a full refund of all fees paid in connection with the registration upon request. However, there is no refund policy for a radio or television server, whether for one-time or annual payments. We do not refund money after completing the order and activating the product because the hosting/accessories offered are intangible and non-refundable goods. We recommend contacting support before purchasing.
7.5 Service Availability and Malfunctions
MediaCP is not liable for any damage or loss suffered by the customer resulting from the service’s unavailability, malfunction, or the customer’s ignorance or incompetence. If the service is not functional or shows errors, the customer has the right to terminate the service, and the last payment for the service will be refunded in full.
7.6 Server Use and Verification
Each user can have a maximum of one free server. Multiple free servers under one account or IP will be automatically deleted. If the server is inactive for more than 48 hours, it will be automatically deleted from the account. The same goes for unverified emails.
7.7 URL and Port streams
If a customer terminates his service, his PORT and URL address will be available for a new client, because the panel allocates free ports automatically for new clients
